GENERAL TERMS AND CONDITIONS
Any business relationships created between Belladonna and customers shall be governed exclusively by the following general terms and conditions. By placing an order, the customer agrees to accept these terms and conditions.
CONCLUSION OF CONTRACT
Belladonna hereby undertakes to accept customers´ orders in accordance with the terms set out in this website. In the event of any spelling, printing or calculation errors, Belladonna is entitled to withdraw from a contract of sale. Corporate orders can only be accepted from companies that are legally registered in Germany.
PRICES, SHIPPING COSTS AND MINIMUM ORDER VALUE
All prices include the statutory rate of VAT but are not inclusive of shipping costs. There is no minimum order value. Shipping costs are set out in the "Shipping Costs" section of the website, where costs are organised into region and country. Free shipping is available for orders of 30 euros and above made within Germany.
DELIVERY ABROAD
We deliver worldwide, offering attractive conditions with no minimum order requirement.
Postage costs for individual countries, methods of payment available and details of our discount system are offered in the list below.
Please note that our goods will only be dispatched in insured packages with our couriers UPS and DHL.
For delivery to countries outwith the EU, customers should be aware of customs regulations applying to the country in question.
DELIVERY
All deliveries will be made from our stock room to the delivery address given by the customer, unless otherwise agreed. Any information offered about delivery times is not binding, unless a specific date for delivery has been agreed to in advance. You will generally receive your order within a few days. If part of your order should not become available within five working days, Belladonna reserve the right to deliver any other goods ordered. The remainder of the order will be cancelled and the bill modified accordingly.
PAYMENT
Payment is due immediately upon ordering. All prices include the statutory rate of VAT.
The customer can pay for goods ordered via direct debit, credit card, PayPal or bank transfer. Payment by direct debit is only possible for customers with an account at a bank based in Germany.
The customer is responsible for the payment of any charges incurred in the bank transfer of money from abroad.
Delivery to first time customers and to all customers abroad will only take place after payment has been received.
The customer shall provide all information required to process the payment. Should it become necessary for a return debit note as a result of insufficient account funds or inaccurate account details given, then the bank charges arising from this shall be borne by the customer. These charges currently stand at 8.11 euros and must be paid immediately. The direct debate mandate also expressly allows for the levying of this charge.
If a customer is in arrears with payments then Belladonna is entitled to impose interest on arrears at 4% over the statutory rate set by the Deutsche Bundesbank (German National Bank). Should Belladonna be able to show further costs were incurred due to such a delay in payment, Belladonna is entitled to seek reimbursement of these costs.
RETENTION OF TITLE
Until all outstanding sums have been settled by the customer, any goods delivered to them remain the property of Belladonna.
WARRANTY FOR DEFECTS
The customer should notify Belladonna of any apparent defect in goods delivered within a period of four weeks, with the right to notify any such defect expiring after this time period. Should Belladonna be responsible for any defect arising, they are entitled to make good such a defect or to offer a replacement of the goods in question. Should Belladonna be unwilling to rectify a defect/replace goods or be unable to do so or to delay unreasonably (for reasons for which Belladonna is accountable) or should the replacement delivery be unsuccessful, then the customer is entitled to withdraw from the contract of sale or to demand a reasonable reduction in the sale price. If faulty goods are to be returned, it is the customer´s responsibility to package the goods carefully and ensure that sufficient postage is attached. In the case of justified claims, the customer will have all postage costs refunded to them.
We regret that we are unable to accept packages sent carriage forward (non-prepaid).
RIGHT TO WITHDRAW
The customer is entitled to withdraw from the contract of sale for a period of two weeks, with this period commencing from the date of receipt of goods by the customer and not before. It is not necessary to offer a reason for such a withdrawal, though it must be made in writing. To comply with these terms notice of withdrawal must be posted within the aforementioned time period of two weeks to:

Upon receiving notice of intention to withdraw, Belladonna is obliged to return any possible payments already made. The customer is similarly obliged to return any goods already sent to them. The right to withdraw applies exclusively to goods which are unused and undamaged. Goods sent carriage forward cannot be accepted and postage costs arising from justified returns shall be refunded, provided the value of the order is more than 40 euros. DATA PROTECTION
Any personal data given by customers shall be used exclusively for the purposes of fulfilling their orders. Belladonna shall not make any such information available to third parties.
LINKS TO OTHER WEBSITES
Important notice regarding all links: The Landgericht (LG) (Regional Court) in Hamburg ruled on the 12th of May 1998, in decision 312 0 85/98 "Responsibility for links" that the making of a link available via one´s own website means that one is also responsible for the content of that link. According to the LG, such responsibility can only be avoided when one explicitly states that one distances oneself from the content of any such links. We hereby distance ourselves expressly from all the content of all the sites linked to our own website and state that the content of these sites is not our own.
